Am I required to appoint a representative under the DSA?
If your organization provides intermediary services in the EU but does not have a physical presence there, it’s highly likely that you are subject to the regulations of the DSA and therefore required to appoint a representative that is established in the EU.
An intermediary service is any of the following digital information services:
- Mere conduit service - transmitting information in a communication network or providing access to a communication network;
- Caching service - transmitting information in a communication network and temporarily storing it only for purposes of making the process smoother when it needs to be transmitted onward to other recipients;
- Hosting service - storage of information for someone upon their request;
- Online platforms - such as search engines, social media platforms, online marketplaces, collaborative economy platforms, and app stores.
